Ma Junwen was found guilty of inciting and splitting the country for Shouting slogans

Ma Jun-wen, 31, known as the second Captain America, was found guilty by a district Court judge on Oct 25 of “inciting others to split the country” for Shouting slogans for Hong Kong independence last year.

Ma was remanded in custody until November 11 for sentencing, while the court will obtain a psychological expert’s report for him, According to Hongkong media.

On June 30, 2020, the Standing Committee of the National People’s Congress of the Communist Party of China adopted the National Security Law of Hong Kong, which stipulates that those who incite or abet others to commit the crime of secession may be sentenced to imprisonment of five to 10 years if the circumstances are serious, and those who commit the crime of secession may be sentenced to imprisonment of up to five years, detention or public surveillance if the circumstances are minor.

Ma Jun-wen was arrested by police on charges of “inciting others to split the country” for repeatedly Shouting slogans of Hong Kong independence outside shopping malls and police stations between August 15 and November 22 last year. Mr. Ma was also denied bail by a Hong Kong High Court judge in December.

Mr. Ma is the first person in Hong Kong to be convicted of violating Hong Kong’s version of the national Security Law purely for Shouting or displaying slogans.

Tang was also convicted in July of inciting others to split the country and terrorism. He is accused of riding a motorcycle with a banner bearing the slogan “Liberation of Hong Kong, Revolution of The Times” and causing injuries to police in Wan Chai hours after the national Security Law took effect. In addition to being charged with inciting others to secession and terrorism, he was also charged with one count of dangerous driving, an alternate charge of terrorism.

The AFP news agency reported that prosecutors said that Ma Jun-wen shouted slogans such as “Liberation of Hong Kong, revolution of The Times,” “Independence of Hong Kong, the only way out,” and “National courage, armed uprising.”

The indictment of Mr. Ma is more of a legal bellwether, the report said, as his crimes did not involve violence but were purely slogans shouted around him.

Mr Ma’s lawyers were quoted as saying their client was merely trying to prove that “the exercise of freedom of expression is not illegal”. They argued that his slogans were “hot air” and “a fool’s ravings” and did not reflect any plans or resources.

In his ruling, District Court Judge Stanley Chan said the defendants clearly had incitement intent, had a political mission to promote Hong Kong people’s belief that Hong Kong could become independent, and intended to infiltrate their agenda into everyone, RTHK reported.

Hong Kong’s national Security Law contains four crimes: secession, subversion, terrorism and collusion with external forces. The four charges target the exercise of Hong Kong citizens’ individual rights, including freedoms of speech, association and assembly, as stipulated in the Basic Law. The charges under Hong Kong’s national Security Law carry a maximum sentence of life in prison.
