Judicial explanation of recognition and enforcement of Taiwan area civil case judgements

China’s Supreme People’s Court on Tuesday June 30, 2015 issued two judicial explanations recognizing and enforcing Taiwan area civil case judgements. These decisions go into effect Wednesday July 1, 2015.

The Supreme People’s Court Hong Kong, Macao, and Taiwan Working Group Office Director He Zhongling said that Mainland courts would also recognize and enforce Taiwan civil court judgments, including adjudication and mediation decisions, and criminal decisions supplementary to civil judgments—especially damage awards.

The promulgation of these two Supreme People’s Court judicial interpretations signifies that the governments on the two sides of the Taiwan Strait are going from hostile mutual non-recognition to limited mutual recognition, and limited legal documentation standardization.
