Attorney’s request for the modification of coercive measures against journalist Gao Yu rejected

Boxun’s correspondent has learned that on Thursday March 26, 2015 renowned female journalist Gao Yu’s attorney received a telephone call from a court officer surnamed Wu at the Beijing Number Three Intermediate People’s Court. The attorney’s request for modification of coercive measures against Gao Yu has been rejected. The reason is that they were extended by higher authorities and that’s considered part of statutory time limits that can’t be altered.

In this regard, Boxun’s correspondent called Gao Yu’s attorney Mo Shaoping before 10 p.m. Attorney Mo confirmed this information to Boxun. But Mo emphasized to Boxun’s reporter that the reason for the Beijing Number Three Intermediate People’s Court’s refusal isn’t tenable. In attorney Mo’s opinion, the coercive measures have already been extended so don’t fall under the statutory time limit for the case. Added to this is the fact that this is the second time the coercive measures have been extended, so that’s more reason they don’t fall under the statutory time limit for the case. For this reason the coercive measures in place against Gao Yu should be modified. But the Beijing Number Three Intermediate People’s Court has stated that just because higher authorities’ approved it, is has the force of law and falls under the statutory time limit for the case.

Attorney Mo told Boxun’s reporter that at present Gao Yu’s physical condition isn’t very good. She has high blood pressure, diabetes, Ménière’s disease and other ailments. Not too long ago she again had a recurrence of a serious illness, and for 10 days was afflicted with vomiting and diarrhea.

Former Deutsche Welle correspondent Su Yutong, who has paid close attention to this case, said: “More than 70-year-old, seriously ill Gao Yu has been subjected to all kinds of pressure and framing because she pulled the fig leaf off the Communist Party (Gao is suspected of leaking the controversial anti-foreign-subversion “Document Number Nine” to foreign media). ‘Baozi’ Xi release her!
